TERMS OF SERVICE AND USER AGREEMENT

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP. BY ACCESSING OR USING JADA, YOU AGREE TO BE BOUND BY THESE TERMS.
1. DEFINITIONS
In these Terms of Service ("Terms"):
- "App" refers to the JADA mobile application and related services.
- "Company," "we," "us," or "our" refers to JADA and its legal owner, Dragon Group, LLC.
- "User," "you," or "your" refers to any individual who accesses or uses the App.
- "Content" means text, images, videos, messages, and other material shared through the App.
- "Services" refers to all features, functionalities, and offerings made available through the App.
2. ACCEPTANCE OF TERMS
By downloading, installing, accessing, or using the App, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the App. We reserve the right to modify these Terms at any time. Continued use after modifications constitutes acceptance of the revised Terms.
3. ELIGIBILITY AND AGE REQUIREMENTS
- 3.1 You must be at least 18 years old to use the App.
- 3.2 You represent that you have the legal capacity to enter into this agreement.
- 3.3 The App is not available to users previously suspended or banned.
4. ACCOUNT CREATION AND SECURITY
- 4.1 To use certain features, you must create an account with accurate, complete, and updated information.
- 4.2 You are responsible for maintaining confidentiality of your login credentials.
- 4.3 You may not share or transfer your account.
- 4.4 You must notify us immediately of unauthorized use of your account.
- 4.5 We reserve the right to suspend or terminate accounts suspected of unauthorized use.
5. ACCEPTABLE USE POLICY
Users may connect, share profiles, and communicate respectfully. Prohibited conduct includes:
- Harassment, hate speech, or abuse.
- Illegal activities (prostitution, drugs, fraud).
- Harmful content (violence, malware, IP infringement).
- Impersonation, fake accounts, bots, hacking.
Violation may result in suspension or termination.
6. CONTENT AND PUBLIC IMAGE POLICIES
- 6.1 Profile images must clearly represent you and must not contain nudity, violence, minors, or copyrighted material without permission.
- 6.2 Suggestive content is permitted if tasteful and non-explicit.
- 6.3 We may remove any content at our discretion.
- 6.4 Users can report inappropriate content; malicious reporting may result in suspension.
7. PRIVACY AND LOCATION DATA
- 7.1 The App uses location to connect you with nearby users.
- 7.2 Location sharing can be controlled in your settings.
- 7.3 We apply industry-standard security but cannot guarantee complete safety.
- 7.4 Users should exercise caution when sharing personal information.
8. SUBSCRIPTIONS AND PAYMENTS
- 8.1 Subscription Plans: JADA Plus offers premium features through auto-renewing subscription plans (monthly, quarterly, and annual). Pricing is displayed in the app and may vary by region.
- 8.2 Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your payment method will be charged within 24 hours prior to the start of each renewal period.
- 8.3 Payment Processing: All payments are processed through the Apple App Store and are subject to Apple's Terms of Service and policies. We do not store or have access to your payment information.
- 8.4 Subscription Management: You can view, change, or cancel your subscription at any time through your Apple ID account settings or via the "Manage Subscription" button in the app. Cancelling a subscription stops future renewals but does not refund the current billing period.
- 8.5 Free Trials: If a free trial is offered, you will be charged at the end of the trial period unless you cancel before the trial ends. Unused trial periods are forfeited upon purchase of a subscription.
- 8.6 Refunds: Except as required by law, all payments are non-refundable. Refund requests must be submitted to Apple, as we do not process payments directly. For information about requesting a refund, visit: https://support.apple.com/billing
- 8.7 Price Changes: We reserve the right to change subscription prices at any time. Price changes will not affect current subscribers until their next renewal period, and you will be notified in advance of any price changes.
9. ACCOUNT TERMINATION AND ENFORCEMENT
- 9.1 We may suspend or terminate accounts for violations, illegal activity, repeated complaints, or attempts to bypass safeguards.
- 9.2 Enforcement may include warnings, suspensions, or permanent bans.
- 9.3 Users may appeal enforcement actions within 72 hours. Decisions are final.
10. INTELLECTUAL PROPERTY
- 10.1 The App and all proprietary content are owned by us.
- 10.2 Users retain ownership of their content but grant us a license to use, display, and distribute it within the App.
- 10.3 You represent that you own or have permission for all content uploaded.
11. THIRD-PARTY SERVICES AND LINKS
The App may include links or integrations with third-party services. We are not responsible for third-party content or practices, and your interactions with them are at your own risk.
12. DISCLAIMERS AND LIMITATIONS OF LIABILITY
- 12.1 We do not guarantee uninterrupted access or error-free operation.
- 12.2 We are not responsible for user interactions.
- 12.3 We disclaim liability for indirect, incidental, or consequential damages.
- 12.4 Your sole remedy is to discontinue use of the App.
13. INDEMNIFICATION
You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, liabilities, or expenses arising out of your use of the App, violation of these Terms, or disputes with other users.
14. SAFETY GUIDELINES
Users should meet in public places, inform friends of plans, avoid sharing sensitive data, and report suspicious behavior immediately.
15. LEGAL PROVISIONS
- 15.1 Governing Law: These Terms are governed by the laws of State of Texas, United States of America.
- 15.2 Dispute Resolution: Disputes will be resolved by binding arbitration where permitted.
- 15.3 Severability: Invalid provisions do not affect enforceability of remaining Terms.
- 15.4 Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement.
16. FORCE MAJEURE
We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, power failures, strikes, government actions, or internet outages.
17. COMMUNITY STANDARDS
Users must act respectfully, engage constructively, and self-moderate behavior. Violations may result in suspension or termination.
18. UPDATES AND MODIFICATIONS
We reserve the right to update these Terms at any time. Updates will be communicated through in-app notifications or email (if provided). Continued use constitutes acceptance.
